Wildergeist — AI Nature Companion

These Terms of Service ("Terms") govern your use of the Wildergeist application ("the App"), operated by Wildergeist Inc. ("we," "us," or "our"). By using the App, you agree to these Terms.
Wildergeist is an AI-powered nature companion that interprets the natural world during outdoor walks. The App uses artificial intelligence to generate insights about the ecology around you — relationships between species, seasonal patterns, ecosystem dynamics, and environmental context.
Wildergeist uses AI to interpret ecological and environmental patterns based on the information you provide, publicly available ecological data, general scientific knowledge, and the shared knowledge base described in Section 5. AI-generated content may contain errors, inaccuracies, or omissions. The App may misidentify species, describe ecological relationships or species behaviors that sound plausible but are incorrect, or present uncertain information with more confidence than warranted.
Treat the App's observations as invitations to look closer and engage with nature, not as authoritative scientific claims. For reliable species identification, use established identification tools and field guides.
The App does not provide foraging, edibility, or consumption guidance under any circumstances. Consuming wild plants or fungi based on incorrect identification can cause serious illness or death. If you are interested in foraging, consult a qualified local expert and use multiple identification resources. Do not eat anything based on information from this or any AI application.
The App may suggest sensory activities such as observing, smelling, or touching natural features. You are responsible for assessing the safety of any interaction with plants, fungi, wildlife, or other natural elements. The App does not identify hazards and cannot determine whether something is safe to touch, smell, inhale, or consume.
The App is a nature engagement tool, not a medical device or therapeutic service. It does not diagnose, treat, cure, or prevent any medical condition. If you are using nature engagement as part of a health or wellness program, follow the guidance of your healthcare provider.
The App is designed to be used outdoors in natural environments. By using the App, you acknowledge that outdoor activities carry inherent risks including but not limited to: uneven terrain, weather exposure, wildlife encounters, water hazards, and limited cellular connectivity.
The App does not monitor your safety, track hazards, or provide navigation. Pay attention to your surroundings, stay on marked trails where applicable, check weather conditions before your walk, and tell someone where you are going.
We are not responsible for any injury, loss, or damage arising from your outdoor activities while using the App.
If you create an account, you are responsible for maintaining the security of your login credentials. You agree to provide accurate information and to update it if it changes. We may suspend or terminate accounts that violate these Terms.
By using the App, you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, process, and store the content you provide through the App — including conversation text, photos, and location data — for the following purposes:
We do not sell individual user photos or content to third parties. We do not use your photos in advertising or marketing materials without your separate, explicit consent.
Anonymized data extracted from your interactions — such as species sightings, seasonal timing, habitat conditions, environmental conditions, trail reports, and visit patterns — becomes part of a shared knowledge base. This data is separated from your personal identity and is retained as part of the collective record even if you delete your account. See our Privacy Policy (Section 4) for details.
Photos you take while using the App may be stored as part of the ecological record alongside their location, date, and time. Photos may be included in the knowledge base and may be used to develop and improve the App's AI capabilities. When photos are displayed within the App or included in licensed datasets, they are separated from your personal identity. If a photo contains identifiable people, you are responsible for obtaining their consent before sharing it through the App.
You may request deletion of your raw walk data (conversation logs, photos, session records) at any time by contacting us or through account settings. Anonymized observations and environmental data that have already been extracted and incorporated into the knowledge base are not subject to deletion requests, as they are no longer linked to your identity. Photos that have been included in licensed datasets in anonymized form prior to your deletion request may be retained in those datasets.
You retain ownership of the photos and text you create. The licence you grant us does not transfer ownership of your content to us. We own the knowledge base and all derived products, including anonymized, structured data extracted from user interactions.

We provide the App "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, or non-infringement.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to: reliance on AI-generated information, injuries sustained during outdoor activities, loss of data, or interruption of service.
Our total liability to you for any claim arising from your use of the App is limited to the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law.
We may update these Terms from time to time. We will notify you of material changes by posting updated Terms in the App and updating the "Last updated" date. For material changes, we will provide at least 14 days' notice before the changes take effect. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the App will be resolved in the courts of Nova Scotia.
